Section 42 of The Road Traffic Offenders Act 1988 makes provision for offenders to apply for the reinstatement of their licence before the end date of the original imposed driving ban.
In deciding these applications judges are allowed to consider the character of the offender and their conduct after the original ban was imposed, the nature of the offence that warranted the ban, and any other relevant circumstances in the case.
To be eligible, you must have served more than two years of the original ban if the ban was for less than four years. If the original ban was for between four and ten years, you cannot apply until you have served half of the ban length. For cases where drivers have been banned for over ten years, they must serve five years of the ban before becoming eligible to apply.
